Purchase Terms

1. Nature of the marketplace

This is an equipment marketplace storefront. Listed prices are asking prices. Inquiries and buy requests are offers. A sale is binding only when Dulling King Marketplace confirms the purchase in writing (email or invoice).

2. Pricing & fees

The purchase price is the amount confirmed in writing on your invoice. Storage, transport, title/lien fees, or third-party charges—if any—are billed separately when disclosed on the invoice.

3. Inquiries & availability

Units may be withdrawn or repriced until a sale is confirmed in writing.
Submitting an inquiry does not reserve a unit unless staff confirms a hold in writing.
We may refuse or cancel a sale for error, fraud, non-payment risk, or technical failure.

4. As-is, where-is

All units sell as-is, where-is with all faults, unless we state otherwise in writing on the listing or invoice. Descriptions, hours, serials, and photos are believed accurate but are not warranties. Inspect when possible. Hours and condition can change while a unit remains in use before removal.

5. No buyer’s remorse / refunds

After written confirmation of sale, purchases are final. No refunds for change of mind, transport issues, financing failure, or discovery of defects that were disclosed or reasonably discoverable. Any exception requires written approval from Dulling King Marketplace before payment clears.

6. Payment, title & removal

Payment is due per the invoice and Payment & Removal page. Title/ownership transfer follows cleared funds and any lien or documentation requirements. Some units have loadout holds or delayed removal dates—those notes bind the buyer.

7. Limitation

To the fullest extent allowed by law, Dulling King Marketplace’s liability for any unit is limited to a refund of amounts paid for that unit. We are not liable for consequential, incidental, or lost-profit damages. Indiana law governs these terms; venue in Marion County, Indiana, unless otherwise required by law.
